Terms of Service – Actura

1. Acceptance of Terms

By accessing or using the Actura platform ("Service"), operated by Arachnid Solutions LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Actura is a plan quoting and research tool for ACA (Affordable Care Act) individual marketplace plans. The Service provides access to plan data sourced from CMS (Centers for Medicare & Medicaid Services) public use files, including premiums, benefits, formularies, service areas, and provider network information.

Actura is not an insurance carrier, broker of record, or enrollment platform. The Service does not facilitate the purchase, enrollment, or binding of any insurance plan. It is an informational and quoting tool only.

3. Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the integrity or performance of the Service
Scrape, crawl, or use automated means to extract data from the Service beyond normal use
Resell or redistribute the Service without written permission
Misrepresent plan data or subsidy estimates to consumers

5. Data Accuracy Disclaimer

Plan data displayed in Actura is sourced from CMS public use files and issuer-published directories. While we make reasonable efforts to ensure accuracy, we do not guarantee that all information is complete, current, or error-free. Premiums, benefits, provider networks, and formulary data may change and may differ from what is displayed on Healthcare.gov or individual carrier websites.

Users should always verify plan details directly with the carrier or the official marketplace before making enrollment decisions.

6. Subsidy Estimates

Subsidy (APTC) and cost-sharing reduction (CSR) estimates provided by the Service are approximations based on publicly available FPL guidelines and benchmark plan data. Actual subsidy amounts are determined by the marketplace during enrollment and may differ from estimates shown in Actura.

7. Fees and Payment

Certain features of the Service may require a paid subscription. Pricing is displayed on our website and may change with notice. Free trial periods, if offered, are subject to the terms described at the time of signup.

8. Intellectual Property

The Service, including its design, features, and original content, is owned by Arachnid Solutions LLC. CMS public use file data is in the public domain. You retain ownership of any data you input into the Service (such as scenario notes and favorites).

9. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. You may cancel your account at any time through your account settings.

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via the Service or email. Continued use of the Service after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
